Editor’s note (Jan 15): The charges against the arrested person in this article were dismissed Wednesday, Jan. 15, according to the Whatcom County Jail list of releases. The name of the man who was arrested has been removed from this article.

A Ferndale man is being charged with first-degree assault after allegedly making threatening gestures with a weapon later identified as a BB gun.

The man was asked to leave a business in downtown Ferndale around 10:30 a.m. Thursday, Jan 8. The owner of the business had called police because the man, a former employee, was causing a disturbance, according to Megan Juenemann with the city of Ferndale.

Police were dispatched to the same area around 12:22 p.m. following a call regarding a subject with a gun. Witnesses said the man was holding what appeared to be a large handgun and pointing it at the business while making shooting motions with the gun, according to court documents.

Police located the man on a sidewalk along Vista Drive. He was arrested without incident, according to Juenemann. Court documents indicate he told officers he had been making shooting motions with a BB gun toward the business in an effort to cause the owner to panic, as a joke.

He is being charged with first-degree assault, a class A felony. He remained in custody at Whatcom County Jail as of Jan. 14.
