Whatcom County authorities arrested a man suspected of committing assault with a non-lethal firearm.

Court documents allege Dillon McKinley Wilson, 34, of Blaine, shot another man three times with a gun that fired rubber bullets and sounded as if it was powered by a CO2 canister. The incident took place Oct. 10 in the 5000 block of Maple Crest Avenue in Blaine.

Wilson and the other man reportedly had been in an argument at the man’s house, which Wilson had visited to retrieve property. Deputies with the Whatcom County Sheriff’s Office located black rubber projectiles at the scene. The second man also showed signs of injury consistent with rubber bullet impacts, according to court documents.

Wilson was contacted by deputies around 1:30 a.m. Oct. 24 in the 7400 block of Birch Bay Drive after they noticed a suspicious vehicle in a parking lot, according to Deb Slater with the Whatcom County Sheriff’s Office.

Slater said the vehicle was suspicious as the front and back license plates did not match. While deputies were talking to two other people, Wilson approached and attempted to get in the vehicle. Deputies who spotted Wilson were aware he had active felony warrants for his arrest.

Wilson was taken into custody and has been charged with second-degree assault with a deadly weapon, a class B felony. He remained in custody at the Whatcom County Jail as of Oct. 30.
