Whatcom County man who pleaded guilty to inappropriately touching girl sentenced

A Whatcom County man who pleaded guilty to sexually assaulting a child will not serve any time in jail, a judge ruled Tuesday.

Luciano Lozano, 65, was arrested in January 2022 after he admitted to his church pastor that he inappropriately touched a 10-year-old girl. The pastor contacted Child Protective Services, who took Lozano into custody.

Lozano posted bail shortly after his arrest. Since then, he has undergone a sexual deviancy evaluation and has been in treatment.

Lozano’s defense attorney and the state agreed that Lozano qualified for a special sex offender sentencing alternative. His prison sentence – which could have lasted more than five years – will be suspended as long as he follows the terms of his alternative sentencing.

A no-contact order has been put in place with the victim, and he must complete five years of sex offender treatment and supervision.

Judge David Freeman followed the agreed sentencing recommendation, stating that it “appropriately addresses the charges.”

“I know this has been an extremely long and difficult process for the victim’s family,” Freeman said.
