Whatcom man arrested for allegedly threatening to kill Semiahmoo Resort staff

A Birch Bay man was arrested Wednesday evening for allegedly calling the Semiahmoo Resort in Blaine dozens of times, using slurs and derogatory terms and threatening to kill the staff.

Kyle Warner Fosberg, 33, was charged May 5 in Whatcom County Superior Court with one count of felony harassment and one count of telephone harassment, a felony.

Fosberg’s arraignment has been tentatively scheduled for May 20, according to court records.

On May 4, Blaine police received a report from a female employee that a man was calling the Semiahmoo Resort repeatedly and making threats to murder the staff, according to court records. The man was later identified as Fosberg, the records state.

When Blaine police arrived, they met with a manager who escorted the officer to the spa area. The officer noticed the main doors to the spa area had been locked, which the manager said was a precaution due to the threats, the court records state.

The officer met with the woman who made the initial report who said that earlier in the day another employee had taken a phone call from Fosberg regarding reservations for a sporting event. As the day continued, Fosberg allegedly called more than 30 times. During some of the calls, Fosberg called the employee several names and used derogatory terms, the records state.

The woman, who is also an employee, said she also took a call from Fosberg during her workday. While attempting to attend to Fosberg’s customer service needs, Fosberg allegedly used a racial slur. When the woman asked Fosberg not to use the slur as it is highly offensive, Fosberg allegedly said the slur again and then told the woman he was going to kill her and her mother on Thursday, according to court records.

The woman told police that doors to the resort had been locked out of fear that Fosberg would cause harm to her or other staff members. The woman was also concerned because Fosberg was local and had identified himself as a member of the resort, the court records show.

Fosberg was arrested May 4 shortly before midnight, and was released from the Whatcom County Jail shortly before 5 p.m. on May 5, jail records show.

Fosberg has previous convictions for harassment, resisting arrest and third-degree malicious mischief stemming from an August 2012 incident in which he threatened to assault a woman and her family.

Fosberg then showed up intoxicated twice to the woman’s house and attempted to use a shovel to break inside.

During the course of his arrest and transport to jail, Fosberg became verbally aggressive, used racial slurs and told an officer he had a Ku Klux Klan tattoo. Fosberg also threatened to blow up the officer’s house and threatened to kill the officer and throw him in the river, court records state.

Fosberg was sentenced to 364 days in jail, with 334 suspended. Fosberg was given credit for time served due to receiving 90-day involuntary inpatient mental health treatment, the records state.

Fosberg also has a conviction for solicitation to unlawfully possess a controlled substance for which he served 200 hours of community service as part of a jail work release or work crew program, according to court records.
