Two men accused of beating a Bellingham man in July 2007 will be retried on second-degree assault charges.
Patrick M. Zemel, a former volunteer firefighter with Whatcom County District No. 10, and Christian A. Beaty have a trial date set for March 30.
After a nine-day trial, a jury failed to reach a verdict and a mistrial was declared Dec. 17. One juror thought that Beaty and Zemel were acting in self-defense.
They are accused of beating Newell Street resident Marcus Hays after he yelled at them to slow down as they drove past him the night of July 26, 2007.
