Men arrested for alleged rape of teen girl at Bellingham house party

THE BELLINGHAM HERALDApril 11, 2014

BELLINGHAM - Two men were arrested for allegedly raping a 15-year-old girl at a Bellingham house party early Sunday, April 6, according to charging documents filed in Whatcom County Superior Court.

Eric N. Zubenko, 18, and Trever R. Jimenez, 21, face charges of first-degree rape and first-degree kidnapping.

The girl arrived at the party after 1:30 a.m. and drank some "Molly water" - MDMA (known in pill form as Ecstasy) dissolved into water - and three or four beers, according to court documents.

The girl was leaving the party and going to her friend's car when Zubenko allegedly grabbed her hand and wouldn't let go. He and Jimenez took her out to Jimenez's car and had sex with her, according to the charges. She reported telling them she didn't want to have sex before trying to push Jimenez off of her, but Zubenko held her hands.

Afterward the girl told her friend, who called police.

Zubenko initially denied having any sexual contact with the girl, but later admitted to police he had sex with her and held her hand while Jimenez had sex with her, according to court documents.

Zubenko told police that "she didn't seem like she was saying no and if she did say no" he didn't hear it, according to court documents.

Jimenez also faces charges of trafficking and possession of stolen property and trespassing, in a case from last year.

Both men have no felony convictions on their records.
