Bellingham man gets 9 months for sexually touching sleeping woman


BELLINGHAM - A Bellingham man must spend nine months in jail for sexually touching a woman while she slept at a party.

Jordan Jerome Smith, 22, of Bellingham, walked into a house party in the Lettered Streets neighborhood in October 2011. He didn't know anyone in the house. Smith later told investigators he drank wine and whiskey that night, so he had difficulty remembering what happened.

Sometime after 3 a.m., he reclined on a fold-out bed where two women and a man had fallen asleep. He started sexually touching one of the women, according to charging documents. She woke up - still somewhat inebriated - and realized what was happening. She told him to get off her. Eventually he did.

Other party-goers recognized Smith in a photo lineup. He admitted to the crime, saying the woman never gave him permission to touch her. He told police he was "very intoxicated and wished he had made a better choice," according to charging documents.

Under the terms of the sentence handed down last week, he must avoid the victim and undergo a sexual deviancy evaluation.

He also agreed in his guilty plea to abstain from alcohol. Court records show Smith had two past convictions for drinking and driving.
