Question: I just read your answer to the question of "Is it illegal to drive if you forgot your license at home," and the answer was basically yes, but officers have discretion as to how to deal with it. I have kept a photo copy of my valid license in the glove box. Would that suffice if I forgot my actual driver's license at home?
Answer: It is illegal to drive without your driver's license in your possession. Having a photo copy is not a substitute for your valid driver's license. Officers do have the discretion as to how they handle this infraction. Personally, I would not want to keep that much personal information in my glove box due to the potential for identity theft.
Q: How slow does a car have to be going to pass them?
A: The car must be traveling slower than the speed limit or the reasonable safe speed due to the road and/or weather conditions. RCW 46.61.400 and 46.61.425 are two of the sections that deal with this.
