  A Whatcom County man sentenced to nine years for selling cocaine has had his conviction reversed after the state Court of Appeals found that prosecutorial errors during his case may have improperly prejudiced the jury against him.

  Antonio Ramos, 53, was found guilty of unlawful delivery of cocaine by a Whatcom County jury in 2010, but the Court of Appeals decision means that he will have to be retried.

  Whatcom County Prosecutor Dave McEachran said the trial should be set within 60 days of getting a mandate from the Court of Appeals that would bring jurisdiction for the case back to Whatcom County. Ramos, whose criminal history includes several drug convictions and bail jumping, will remain in custody throughout the retrial.

  Three men were arrested early Monday in Pasco for allegedly beating up a store clerk while trying to steal some beer.

  The men entered the 7-Eleven at 14th and Sylvester streets about 2 a.m. One of them tried to distract the clerk while the others allegedly grabbed a six-pack of beer and left the store.

  The clerk went outside to confront the men and was pushed to the ground and repeatedly kicked, said Pasco police Capt. Jim Raymond. The suspects then drove away in a white Kia Optima.

  When Tri-City restaurateur Marty Martin was diagnosed with colon cancer in 2007, there was one chance in 10 million that his brother might also have the same disease, especially since there was no family history of cancer and both were under 50.

  But Marty kept bugging his brother Darren to get checked out, especially because Darren had not been feeling well.

  "He was adamant about me going in because I'd had some stomach troubles," said Darren, owner of the Magill's restaurants in Pasco and Richland.
